Terms of Use Agreement

This agreement is effective and enforceable once you approve it and begin registering in the store under Article 10 of the Saudi Electronic Transactions Law.

Article 1 - Introduction and Definitions:

The above preamble is an integral part of this agreement. Below are the definitions for the key terms used in this agreement:

1. (The Store): This definition includes all forms of the store on the internet, whether it is an electronic application, a website, or a commercial outlet.

2. (The Consumer): The person who engages in electronic commerce seeking to obtain products or services provided by the store via its electronic platform.

3. (The Agreement): Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties.

Article 2 - Legal Capacity of the Consumer:

1. The consumer acknowledges that they have the legal capacity considered under Sharia and law to deal with the store, or that they are at least eighteen years of age.

2. The consumer agrees that in the event of violating this article, they shall bear the consequences of such violation before third parties.

Article 3 - Nature of Obligation:

1. The store's obligation toward consumers is to provide the (service or product).

2. The store may provide other services such as after-sales services or other related services, depending on the nature and type of the (service or product) requested by the consumer.

Article 4 - Guidelines for Use:

1. The consumer is committed to using the store's electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2. When purchasing a service or product, the consumer is committed not to use it in violation of public morals or regulations in the Kingdom of Saudi Arabia and to adhere to all terms found in the description of each product.

3. The consumer is committed to maintaining the product received, especially if it is a shared product. They have no right to tamper with it or attempt to change its information. The merchant has the right to withdraw the product or ban the consumer without compensation in case of violation.

Article 5 - Accounts and Registration Obligations:

Upon applying for membership in this store, you are committed to disclosing specific information and choosing a username and secret password. You hereby agree to:

1. Be responsible for maintaining the confidentiality of your account information and password. You agree to notify the store immediately of any unauthorized use of your account or any other breach of your confidential information.

2. The store shall not be liable for any loss, direct or indirect, moral or material, resulting from the disclosure of the username or password.

3. You are committed to using your account yourself, as you are fully responsible for it. Use by others is a presumption that you have authorized them to use the store in your name.

4. You are committed to using the store with seriousness and credibility.

5. You are committed to disclosing true, correct, updated, complete, and legal information about yourself during registration and to update it when necessary.

6. Our store is committed to treating your personal information and contact addresses with strict confidentiality.

7. If it appears to the store that you have disclosed false, incorrect, outdated, incomplete, or illegal information, the store has the right to suspend, freeze, or cancel your membership/account without prejudice to the store's other rights to recover its dues and protect other consumers.

8. In case of non-compliance with the above, the store management has the right to suspend or cancel your membership, withdraw your products without compensation, or block you from accessing the store services again.

Article 6 - Electronic Communications and Official Means of Contact:

1. The parties to this agreement agree that communication is conducted via the email registered in the platform.

2. The consumer agrees that all agreements, advertisements, and other communications provided electronically serve as their written counterparts and are self-standing evidence in meeting legal requirements.

3. The consumer agrees to the possibility of being notified of any provisions of this agreement or dealings through general messages sent to all users or specific users.

Article 7 - Amendments to the Agreement and Fees:

1. If any article or clause in this agreement is canceled or is no longer enforceable, such an event does not void the validity of the remaining articles, which shall remain in effect until further notice.

2. This agreement—which is amended from time to time as necessary—constitutes the mechanism of work and understanding between the consumer and the store.

3. The store may impose fees on some consumers depending on the offers, products, or services requested, or any government-imposed fees or taxes.

4. The store reserves the right to add, increase, reduce, or discount any fees or expenses under the terms of the agreement for any consumer regardless of their reason for registration.

Article 8 - Payment Services:

1. The store, through its partners, provides a payment system that can be entirely online through the available payment options or any method provided by the store from time to time.

2. The store is committed to determining the price of the service or product according to the recognized market value.

3. The store is committed to providing invoices and receipts for all amounts and transactions and shall provide the consumer with a purchase invoice.

Article 9 - Intellectual Property:

1. Intellectual property rights of the store are fully owned by the store, whether owned before or after the establishment of this platform.

2. The consumer must respect the intellectual property rights of the store, including the store name, words, logos, and other symbols displayed on it.

Article 10 - Store Responsibility:

1. The store is committed to conducting its business via this platform in a regular manner and in accordance with the regulations of the Kingdom of Saudi Arabia and this agreement.

2. The store bears no responsibility for claims arising from errors or negligence, whether direct, indirect, or accidental, caused by the consumer or a third party such as shipping companies.

3. The store, its employees, and owners are committed to ensuring the (product or service) is sound, legitimate, and authorized according to the laws of the Kingdom of Saudi Arabia.

Article 11 - Restriction of Access or Membership:

The store may suspend or cancel the consumer's membership or restrict their access to platform services at any time, without notice, and for any reason without limitation.

Article 12 - Governing Law:

This agreement is governed by and drafted according to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is fully subject to the authorities therein.

Article 13 - General Provisions:

1. Arabic is the language applicable for interpreting or translating the provisions of this agreement.

2. All prices displayed for services or products may be modified from time to time.

3. Promotional or marketing offers are temporary, and the store has the right to modify or stop them at any time.

4. The parties are committed to dealing in a manner that does not violate Sharia rules and relevant laws.

5. This agreement is only canceled by a decision issued by the store management.
